The lottery generated a profit of nearly $1.2 billion in the fiscal year, which is a record for the state. In FY2022, scratch-off games produced a total of $3.5 billion in ticket sales, 6.5% lower than the year prior. The company also saw an increase in ticket sales through online games.
Wire act prohibits online lotteries
New Hampshire lottery officials recently filed a lawsuit against a vendor of the lottery, NeoPollard Interactive, for violating the Wire Act. The suit challenged a recent Department of Justice opinion that held that the Wire Act applied to all forms of wagering, not just sporting events. This opinion superseded a 2011 Office of Legal Counsel opinion that said the Wire Act only applied to sports events. Although the New Hampshire lottery began offering online lottery sales before the 2018 opinion, it still filed the suit in order to fight the new interpretation. The New Hampshire lottery commission claimed that the opinion was “arbitrary and unreasonable,” and argued that the ruling should be overturned.
